    <description>The FDA published Guidance for Industry (GFI) #263 in June 2021 which outlined a plan for transitioning certain over-the-counter (OTC) antimicrobial products for animals to prescription (Rx) status.&amp;nbsp;As outlined in FDA&amp;rsquo;s Guidance for Industry (GFI) #263, we expect approved animal drug products containing medically important antimicrobials that are currently available as OTC products to transition to Rx status beginning in June 2023. To help prepare for this transition, FDA/CVM is conducting outreach to increase awareness about this expected change. Outreach efforts so far have included disseminating information in September to some target audiences (TX, AZ, OR) through radio and social media.

CVM has also developed some written materials that we hope will be helpful. Below are links for species-specific fact sheets - these include information on products/indications that will be transitioning as part of GFI 263 and information on how interested animal owners can locate a vet. Also linked below are a brochure and poster which detail the importance of veterinary involvement as products transition to Rx.

Below are important facts to consider when practicing telehealth: 


 Personal examination is a face to face, in person, examination of the patient.
 The practice of&amp;nbsp;veterinary medicine&amp;nbsp;occurs where the patient is located at the time telehealth services are provided.
 A veterinarian-client-patient relationship&amp;nbsp;is required for providing veterinary care via telehealth services.&amp;nbsp;The veterinarian shall perform an in-person exam within the 12 months prior, and at least every 12 months thereafter or the telehealth service shall no&amp;nbsp; longer be available to the patient.
 In the event of an imminent, life-threatening emergency veterinary care may be provided via telehealth services without an existing veterinarian-client-patient relationship or without an in-person visit within 12 months.
 The standard of care for&amp;nbsp;providing veterinary care in the State of West Virginia via&amp;nbsp;telehealth services&amp;nbsp;by a registered or licensed veterinarian&amp;nbsp;shall be the same as for in-person care.
 A provider of telehealth services must ensure that the client is&amp;nbsp;aware of the veterinarian&amp;rsquo;s&amp;nbsp;identity, location, and license number and licensure status and should provide to the client a clear mechanism&amp;nbsp;to:
 
  Access, supplement, and amend client-provided contact information and health information about the patient;
  Register complaints with the Board;
  Provide consent for the use of telemedicine and,
  Patient medical records must meet the requirements as specified in the Standard of Practice Rules.
  Shall not prescribe any controlled substance listed in Schedule II of the Uniform Controlled Substance Act via&amp;nbsp;interstate&amp;nbsp;telehealth services
 
 


Below is information regarding Veterinary Telehealth Registration:


 A veterinarian not licensed by the Board must apply for and obtain registration with the Board using the application materials provided by the Board and paying a fee of&amp;nbsp;$300.
 A veterinarian that currently holds a WV veterinary license is not subject to registration but shall practice telehealth in accordance with the Board&amp;rsquo;s laws&amp;nbsp;and the rules.
 A&amp;nbsp;registrant&amp;nbsp;is subject to the laws, rules, and regulations regarding the&amp;nbsp;practice of veterinary medicine&amp;nbsp;in this&amp;nbsp;state, including the&amp;nbsp;state judicial system and all rules and standards of professional conduct contained within &amp;sect;30-10-1 et seq. of this code and the rules promulgated thereunder.
 A&amp;nbsp;registrant&amp;nbsp;shall&amp;nbsp;notify the&amp;nbsp;Board&amp;nbsp;within 30 days&amp;nbsp;of any restrictions placed&amp;nbsp;upon, or actions taken against,&amp;nbsp;his or her&amp;nbsp;license to practice in any&amp;nbsp;other&amp;nbsp;state or jurisdiction.
 A registration&amp;nbsp;with the Board&amp;nbsp;does not authorize a&amp;nbsp;veterinary&amp;nbsp;care professional to practice from a&amp;nbsp;physical location within the State&amp;nbsp;of West Virginia&amp;nbsp;without first obtaining appropriate&amp;nbsp;facility registration.

It is recommended that a witness also sign the inventory forms.&amp;nbsp; There are fields on the inventory that are required; such as, close of business day or beginning of business day.&amp;nbsp; If audited by the DEA, 1 missing field could cost over $15,000. Templates are located on the Boards website.&amp;nbsp; DEA Regulations can be found at www.ecfr.gov.&amp;nbsp; 

Schedule I-II controlled substances and Schedule III-V documents must&amp;nbsp; be separated from each other but can be in the same binder.&amp;nbsp; All documents must be readily accessible; so they must be printed and accessible.&amp;nbsp; 

&amp;middot;&amp;nbsp;Initial and Biennial Inventory

&amp;middot;&amp;nbsp;Form 222

&amp;middot;&amp;nbsp;Invoices 

&amp;middot;&amp;nbsp;Receipts 

An initial inventory must be completed on the initial day of receiving a DEA permit or when a veterinarian in charge has changed.&amp;nbsp; If you do not have any inventory, then list &amp;ldquo;0&amp;rdquo; as your inventory total. A form template is located on the Boards website.&amp;nbsp;

A biennial inventory must be completed by every DEA registrant every 2 years from the date of the last annual or biennial inventory.&amp;nbsp; Of course, inventories can be done more than every 2 years.&amp;nbsp;&amp;nbsp; A form template is located on the Boards website.&amp;nbsp;

Ordering Controlled Substances 

For Schedule I&amp;mdash;II complete DEA Form 222 to order controlled substances .&amp;nbsp; Keep form for 2 years.&amp;nbsp; Must write on form the date and quantity received.&amp;nbsp; 

For Schedule III-V are invoiced by the vendor.&amp;nbsp;

Loss of Controlled Substances 

Notify DEA within 24 hours to report loss of controlled substances and then complete DEA Form 106.&amp;nbsp; Loss of drugs in transit should be done by the vendor.&amp;nbsp; There must be a police report for theft of a controlled substance.&amp;nbsp;

Disposing of Controlled Substances&amp;nbsp; Options

&amp;middot;&amp;nbsp;An approved DEA Reverse Distributor or 

&amp;middot;&amp;nbsp;Incinerator&amp;nbsp; 

&amp;middot;&amp;nbsp;DEA Form 41 must be completed and a witness&amp;rsquo; signature is required.&amp;nbsp;

&amp;middot;&amp;nbsp;If you do not have an incinerator, you can transfer your controlled substances to another willing facility that has an incinerator by using the DEA Form 222.&amp;nbsp;

WV Pharmacy Permit

&amp;middot;&amp;nbsp;Is NOT required if a veterinarian has the DEA permit.

&amp;middot;&amp;nbsp;Is required if a facility has a DEA permit and the veterinarians are using the facility DEA permit instead of their own DEA permit.&amp;nbsp;

    <description>The WV Board of Veterinary Medicine has been informed that there are a number of CAET&amp;#39;s using cardiac puncture (a.k.a. heart stick) when euthanizing cats.&amp;nbsp; The Board&amp;rsquo;s stance is that cardiac puncture is only allowed if it is used as a&amp;nbsp;&amp;ldquo;last resort&amp;rdquo; method on animals that are non-responsive.&amp;nbsp; A responsive animal must be sedated prior to the use of cardiac puncture.

If the CAET is unable&amp;nbsp;to access a peripheral vein, an alternative technique is intraperitoneal injection that is described in the CAET Training Manual.&amp;nbsp; The Board will continue teaching this method in the annual CAET initial training program.

A person who is a regular student in an accredited or approved college of veterinary medicine is not prohibited from performing duties or actions assigned by instructors or preceptors or working under the direct supervision of a licensed veterinarian. It has been interpreted that a licensed veterinarian or clinical faculty at such a veterinary college must directly supervise the student during any procedure, which does include surgery. The supervising veterinarian retains the responsibility for any adverse outcomes.
